GENERAL TERMS AND CONDITIONS OF SALE

1. GENERAL PROVISIONS

1.1 These general terms and conditions of sale ("general conditions") govern the sale of accessories from the Les Malou Accessories collections (hereafter, "products"), headquartered at Piazza Sant'Angelo, 1, Milan, VAT number 06155130963, email info@lesmalou.it, via the dedicated area of the website www.lesmalou.it, following the procedures outlined on it.

1.2 For the purposes of these general conditions, the end consumer ("customer") refers to any natural person, capable of legal action, over 18 years of age, who purchases goods for purposes unrelated to any business, commercial, artisan, or professional activity they may carry out.

1.3 Les Malou Accessories may refuse to fulfill orders from entities not classified as end consumers or not meeting the company's commercial policy requirements, particularly those identified as corporate entities.

1.4 For any information regarding these general conditions and/or purchases made based on them, interested parties may send an email to info@lesmalou.it.

1.5 These terms and conditions govern solely the proposal, submission, and acceptance of purchases for products sold through the website www.lesmalou.it.

2. CONTRACT CONCLUSION

2.1 The contract is concluded in Italy between the customer and Les Malou Accessories.

2.2 Before making a purchase, the customer is required to carefully read the general conditions of sale provided on the website www.lesmalou.it.

2.3 To place an order, the customer must complete and submit the appropriate order form to Les Malou Accessories. The customer submits a purchase proposal for the products by sending the order form in electronic format.

2.4 Upon sending the order form, an order summary page appears with the characteristics of the ordered product.

2.5 By submitting the order, the customer agrees to pay for the product's price. The products remain the Seller's property until the Customer has completed payment. In case of non-payment or lack of confirmation of successful payment, the purchase contract is legally terminated as per art. 1456 c.c., and the Customer will be notified by email of the contract termination.

The contract is deemed concluded when, following the customer's payment, Les Malou Accessories receives and accepts the complete and correct order form.

Les Malou Accessories will ship the products only after receiving confirmation of the total payment.

2.6 The order form is retained as long as necessary to fulfill the order.

2.7 The customer will receive an invoice by filling in the required fields in the billing address. The invoice will be sent by email after the order has been processed.

2.8 The contract languages are Italian and English.

3. AUTHENTICITY GUARANTEE AND INTELLECTUAL PROPERTY RIGHTS

3.1 Les Malou Accessories guarantees the authenticity of all products purchased on the website www.lesmalou.it.

3.2 The "Les Malou Accessories" trademark, as well as the set of figurative and non-figurative trademarks, service marks on the products, related accessories, and/or packaging, shape marks, whether registered or not, and all illustrations, images, and logos protected by copyright, and more generally, all intellectual property rights related to the products, remain the exclusive property of Les Malou Accessories.

4. INVALID ORDER PROPOSAL

4.1 All orders are subject to acceptance by Les Malou Accessories, which reserves the right to refuse any order proposal at its sole discretion, if:

• The data provided by the customer in the order form is incomplete or incorrect;
• The customer does not qualify as an end consumer or does not meet the payment requirements according to Les Malou Accessories' business policy;
• There are past disputes with the customer regarding order payments;
• The ordered products are unavailable. In such cases, Les Malou Accessories is not responsible for changes in product availability. If only part of the ordered products are unavailable and there are no other valid reasons to refuse the order proposal, Les Malou Accessories will proceed with the order proposal for the available products.

5. PRODUCT INFORMATION

Each product is accompanied by a data sheet illustrating its main characteristics ("Product Page"). The images and descriptions on the Shop reflect the product's characteristics as closely as possible. However, product colors may differ from the real ones due to the user's computer settings. Also, Product Page images may differ in size or accessory items; therefore, these images are considered indicative. The purchase contract relies on the Product description in the order form submitted by the user.

Each product is handmade from various materials, so slight differences from the images are permissible, highlighting the uniqueness of each piece.

6. PRICES

6.1 Product prices are expressed in Euros and do not include shipping costs, which will be added to the total amount.

6.2 Les Malou Accessories reserves the right to modify the prices listed on the site at any time. Les Malou Accessories cannot be held responsible for any price variations.

6.3 The prices indicated on the Italian language version of the site apply solely to purchases within Italy. Prices on the English language version apply to purchases outside Italy.

7. PAYMENT METHODS

7.1 The customer agrees to pay for the products by secure servers using a credit card (if the user does not have a PayPal account) or through their PayPal account.

7.2 Accepted credit cards by PayPal are: Visa, Maestro, MasterCard, American Express, Postepay.

7.3 Credit card payments are managed directly by PayPal's secure servers, ensuring secure online transactions through SSL 128-bit encryption. Consequently, Les Malou Accessories does not have access to the customer's credit card information, respecting their privacy.

7.4 Upon receiving the order, Les Malou Accessories, through PayPal's secure servers, requests pre-authorization on the customer's credit card to ensure sufficient funds for the transaction.

7.5 Credit cards are subject to verification and authorization by their issuing entity. Les Malou Accessories is not responsible for any lack of authorization by the issuing entity. Once the contract is concluded per article 2.5, the credit card charge is final.

7.6 Registered PayPal users can pay directly through their PayPal account.

7.7 By purchasing on www.lesmalou.it, customers accept the policies related to the storage/use of personal data and the use of cookies. Confidential payment data (credit card number, cardholder, expiration date, security codes) are acquired by the payment provider (UBI BANCA), acting as an autonomous data controller, without passing through Les Malou Accessories' server. Data is acquired in encrypted format following PCI security certification requirements and handled via TLS protocol.

8. PRODUCT SHIPPING

8.1 Products are delivered based on the timelines and method specified in the selected delivery service listed in the order.

8.2 Transportation costs are the customer's responsibility and may vary depending on the delivery country; the service will be performed by couriers designated by Les Malou Accessories. Shipping costs are calculated per order based on the destination and weight of the package.

8.3 The customer can check the delivery status through the tracking code emailed by the courier.

8.4 Product shipments are only made to countries indicated at checkout, selectable in the "delivery address" section.

8.5 Les Malou Accessories is not responsible for delays or non-delivery by the courier. Once products ordered by the customer are picked up by the courier, all delivery responsibilities rest solely with the courier. Les Malou Accessories is not liable for losses, thefts, or damages during shipment.

8.6 If delivery is abroad, customs duties and import taxes are the customer's responsibility. As the importer, the customer must comply with the import regulations of the respective country.

9. RIGHT OF WITHDRAWAL

9.1 The customer has the right to withdraw without penalties and without specifying the reason, within 14 days from the receipt of the purchased products.

9.2 Withdrawal must be exercised within the stated period by returning the purchased products after initiating the return process by contacting Les Malou Accessories through the "Withdrawal" form or by other clear communication to withdraw from the contract, including the Product name, the date of order or receipt, and the customer's name and address.

9.3 The customer's right to withdraw is contingent on the preservation of the products’ integrity. Products must not be used, worn, washed, or damaged; the identification tag must still be attached with the single-use seal, and internal labels for brand, composition, and washing instructions must remain intact.

9.4 According to article 55, paragraph 2, letter d), of the Consumer Code, the right of withdrawal, cancellation, or return is excluded for customized orders, specifically those using colors, materials, or embroideries expressly requested by the customer during purchase.

9.5 Return costs are the customer's responsibility.

10. REFUNDS

10.1 If the right of withdrawal is correctly exercised, Les Malou Accessories will refund the amount using the same method of payment, within 30 days from the date they were informed of the withdrawal, provided the products were returned.

10.2 Otherwise, Les Malou Accessories will not refund the customer's request.

11. APPLICABLE LAW AND JURISDICTION

11.1 These general terms and conditions of sale are governed by Italian law, particularly Legislative Decree September 6, 2005, no. 206 on consumer rights in contracts, with specific reference to distance contracts and Legislative Decree April 9, 2003, no. 70 on electronic commerce. 10.2 Unless otherwise stated by applicable law, all disputes arising from the interpretation or execution of these general terms of sale are exclusively under the jurisdiction of the court of Milan, with the parties waiving any other concurrent or alternative jurisdiction.

12. AMENDMENTS TO THE GENERAL CONDITIONS

12.1 These general terms and conditions may be subject to amendments over time, and the new provisions will become effective starting from the date of publication on the website www.lesmalou.it.

13. POLICY

13.1 By making a purchase on the website www.lesmalou.it, customers accept the policies regarding the storage/use of personal data and the use of cookies.
